RENTAL AGREEMENT FOR x GUESTS
On behalf of myself and the persons named on this page, I wish to rent the property specified below, and I agree that this rental is subject to the terms and conditions listed on the following pages. This is the entire agreement applicable to the rental of the property.
I agree that the booking and this Agreement are not effective until my nonrefundable deposit is received by Owner. I agree that the balance of the rental fee, security deposit, services fees, applicable taxes and any fees for excessive cleaning or utilities usage, are payable under the terms and conditions of this Agreement.

Please note: You may add people to your reservation up to one month in advance of your arrival. Each person beyond X requires a supplemental payment of $112 per night, including tax. Names of all people staying at the house must be submitted to owner in writing no later than one month before your arrival.

TERMS AND CONDITIONS
Security Deposit
A security deposit in the amount specified above is due upon payment of the balance of the rental amount. Owner may deduct charges for utilities and cleaning as described below, non-local telephone calls, Pay-per-view, charges at Spanish Bay Resort, services, repairs and replacement, etc., from the security deposit, with any unused portion reimbursed within 21 days of the end of the rental term unless Owner reasonably requires additional time to determine damages. Owner will furnish Occupant an itemized statement of any charges against the security deposit. No interest will be paid on security deposits.
Excessive Utilities
The rental charge includes payment for normal utilities usage, calculated based on historical utilities usage in the property. We have Smart Meters installed for gas and electric, and usage based on days and times can be accurately calculated. The Occupant shall be responsible for utilities usage that exceeds one hundred twenty five percent (125%) of the normal amount. The governor of California has declared a state-wide water emergency because of the drought, and water use is expensive. PLEASE help us conserve water! Please turn off jets in spa and cover spa when not in use, do not run furnaces with the doors and windows open, turn lights out during the day, run full loads in the washer and dishwasher and conserve water in any way you can. Thank you!.
Extra Cleaning
The rental amount and/or cleaning charge include payment for normal cleaning at the end of the rental term. If the condition of the property requires extra cleaning significantly beyond the norm or the Occupant requests extra cleaning services, the Occupant shall be responsible for the cost of such cleaning. A short-stay cleaning fee of $150 will be charged for rentals of 3 days or fewer.
Holding Over
If Occupant departs after the check-out time, Occupant will be subject to a charge of one day at the normal daily rental rate. If such holding over disturbs other guests of the property, Occupant additionally will be responsible for all resulting costs and damages.
Reasonable Use
Occupant agrees to use the property only as a private vacation residence for the individuals listed on the preceding page(also considered the maximum occupancy). No other day use or overnight guests are permitted without written consent of Owner. Occupant will not hold an event, party, wedding or gathering that exceeds the maximum occupancy displayed on the contract without written consent from Owner. We do not allow “drop in” visitors, day or night, without advanced written permission. Violation of any of these conditions will result in forfeiture of entire security deposit. Occupant acknowledges that a party or gathering on the property may require a governmental permit and will cause an additional site fee charge of no less than the amount of the security deposit, and may be grounds for immediate removal from the property. Occupant agrees that the members of Occupant’s party shall conduct themselves in a manner that will not disturb the neighbors' peaceful enjoyment of their properties, and that any consequences of their failure to do so shall be Occupant’s sole responsibility. Occupants further agree that they will not allow the property to be used for any improper or illegal purposes.
Late Payment /NSF Check Fees
In the event payment of any amount is not made within 7 days of the date on which such payment is due, a $100 late payment fee may be added to the total amount due. Occupant shall pay a handling charge of $50 for each check returned by the bank for any reason.
Right to Cancel
A fee will be charged for cancellation, regardless of the reason, including weather, health or travel considerations. The fee will equal the amount of the deposit paid or required as of the date of receipt of notice of cancellation under “Payments Due” above. Fee for cancellation made within one month of date of occupancy will equal full rental amount. Occupant agrees that this cancellation fee shall be deemed reasonable given the timing of the rental and the difficulty of obtaining replacement rentals on short notice. There is no refund if Occupant chooses to vacate the property unless it is due to operational problems significantly affecting Occupant’s use, of which Occupant has advised Owner and Owner has not repaired.
Pets and Smoking
Occupant agrees not to bring a dog or other pet to the property without the express written consent of Owner. Occupant will pick up and dispose of any pet waste. Be in control of your dog and observe the leash law at all times when outside the house or courtyard. At no time shall a pet be left in the house when renters are absent, unless the pet is crated, in the greenhouse, or the dog run. Pets are not allowed on the furniture! Vacuum all dog hair before departure.
NO SMOKING is the rule insidethe property, except in the greenhouse with the door to the piano room closed. No cigar smoking anywhere on the property. Please do not throw cigarette butts on the grounds. Occupant shall be responsible if any person during the term smokes in the home. Occupant will be charged an additional cleaning fee of no less than $500 if smoking occurs inside the residence, and Occupant is responsible for any additional cleaning or damage incurred.
Liability for Damage
Specific operating instructions for equipment and appliances at the property are located at the property. It is very important that occupant read these instructions. Occupant agrees to carefully follow operating instructions in order not to harm or cause malfunctions of the equipment or the property. Occupant shall properly use, operate and safeguard the property, including its furniture and fixtures, and keep them clean and sanitary. Occupant is responsible for all damages to the property caused by Occupant, the members of Occupant’s party, or their guests, whether due to not following the operating instructions or otherwise. Occupant is responsible for ensuring that the property is left upon departure in the same condition and repair as upon arrival, subject to normal cleaning requirements. Occupant shall pay for repair of drain blockages or stoppages unless caused by defective plumbing. Owner will bill Occupant for any and all necessary replacement and repair costs within 45 days of the end of the rental term. Occupant specifically agrees that he/she will place no objects on the Steinway grand piano.
Right to Repair
Occupant shall provide prompt, detailed telephonic notice to Owner of any damage or disrepair to or affecting the property, or any breakage or other operating problems at the Property, while Occupant is at the Property. Owner will take all reasonable actions to address the repair or other problem as promptly as reasonably feasible. If such damage or disrepair is not the result of the action or inaction of Occupant, and if such damage or disrepair significantly interferes with the use of the property, Owner shall have a reasonable time to replace or repair the same without a reduction in Occupant’s rent.
Sewer
Our home is on the public sewer, but is below the grade of the sewer line and therefore waste is pumped from a holding tank up to the street elevation. Because of the extra strain on the system, the garbage disposal must not be overloaded. Please throw most food scraps in the garbage and use the disposal for small food particles only, to prevent clogging of the kitchen sink and dishwasher. Use only the toilet paper supplied at the house as it is safe for septics. Do not flush feminine products.
Rooftop area off Master
There is a deck off the Master bedroom for your use. However, the rooftop areas accessible through the large windows in the Master and other bedrooms are NOT DECKS AND DO NOT HAVE SAFETY RAILINGS. They are not to be used by occupants for any reason.
Shared driveway
To minimize the impact on the natural environment, we and our next-door neighbors agreed to share driveway access to our homes. There is NO PARKING on any portion of the shared driveway. Please be considerate of our neighbors by making sure their access to the driveway is never blocked, and that ambulance and fire truck access to both houses is always open.
Irregular walkway
The cobblestone pathway in our courtyard is constructed of natural beach rock and is an irregular surface. High-heeled shoes should not be worn on this pathway and care should be taken when traversing it.
Hot tub
Always cover the hot tub when not in use, and do not exceed 104 degrees. OCCUPANT ACKNOWLEDGES THAT THE SPA MAY BE UNCOVERED AND/OR UNPROTECTED BY FENCES AND THEREFORE MAY CONSTITUTE AN INHERENTLY DANGEROUS CONDITION FOR WHICH OCCUPANT ACCEPTS FULL RESPONSIBILITY DURING THE TERM AND, WITHOUT LIMITING THE FOREGOING, OCCUPANT WILL DEFEND, INDEMNIFY AND HOLD HARMLESS OWNER AGAINST ANY CLAIMS RELATED TO THESE CONDITIONS.
Access to Property/ Garage Door Opener
Upon notice to Occupant, Owner may enter the property for necessary maintenance, repairs, or other reasonable purposes. Caretaker may be present in the caretaker’s apartment on the property, and is there to assist you.
Occupant shall be furnished with the combination to locks at the property and a garage door opener. Occupant shall properly secure and lock all windows and doors upon checking out, and shall leave the garage door opener on the kitchen island. PLEASE NOTE: When the front door knob is unlocked with the key, it will still lock when the door is shut, unless the button on the inside of the knob is popped out to unlocked position. To prevent being locked out, be sure to note whether the doorknob is in locked position when you shut the door. (The doors to the Master bedroom, greenhouse, kitchen and playroom all have similar doors.)
Security
The property is equipped with exterior security cameras for your protection, and ours. The only interior security cameras are in the parking area and laundry area of the garage.
Caretaker
The caretaker may or may notbe present at the property. The caretaker’s suite is at the back of the property, and is accessible by a separate entrance. The caretaker is available to answer questions about appliances, entertainment systems, hot tub operation, etc. But unless the caretaker is asked for assistance, they will stay out of the way during your visit in our home. Phone number for the caretaker is 831 595 0670, unless a substitute caretaker will be looking after the property, in which case an alternate contact number will be provided. Please do not park in the spots by the trash cans, which are reserved for the caretaker, massage therapist, yoga instructor, and service vehicles.
Limitation of Liability and Indemnification
The liability of Owner or its agents shall be limited to damages arising solely from Owner’s gross negligence or willful misconduct, and then only up to the amount of any rentals and deposits paid. In no event shall Owner or its agents be liable for any special, consequential, incidental or punitive damages. Occupant agrees to indemnify, defend, and hold harmless Owner from and against any claim, dispute, cost, loss and liability for loss, cost, personal injury or property damage sustained by any person (including Occupant’s guests) as a result of any cause during Occupant’s rental term. If the property becomes unavailable for occupancy by Occupant during the term for any reason, Owner shall not be liable for any damages but shall be responsible for refunding all deposits of Occupant.
Natural Property
The Property is in a natural location with natural hazards. The ocean is our backyard. The rocky beach can be hazardous. Animals such as mountain lions, deer, coyotes, raccoons, sea lions, sea otters, cats and birds of all kinds frequent the property. Occasionally the body of a sea mammal will wash upon the beach and create an unpleasant odor. This can continue until a high tide floats the animal out to sea. Because we are at the end of the grid, electrical outages can take longer for the utility company to repair. Occupant understands, acknowledges and accepts these conditions.
COVID-19 WAIVER OF LIABILITY AND INDEMNIFICATION
1. I agree that I am personally responsible for the safety and actions of my family and guests while staying at Kirstie’s Beach House at Rocky Shores. With full awareness of the risks involved, I, for myself and on behalf of everyone on my guest list, hereby forever covenant not to sue Rocky Shores LLC, its owners, independent contractors, or employees (collectively the “Released Parties”) for any liability whatsoever, including injury or death, that may be related to COVID-19. I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims or judgments (including attorney fees) arising from bodily injury, death, loss of use, or any other cause related to COVID-19. I am at least eighteen (18) years of age and fully competent.
2. If any person in my party is exposed to Covid-19, or diagnosed with Covid-19, they are required to self-quarantine for 5 days, and I am required to inform Kirstie Wilde of any Covid-19 exposure in my party. If the start of the rental period falls within this 5-day period, that person or persons will not be allowed entry to Kirstie’s Beach House. I understand that no refund of rental payments will be given in that case, and that I am encouraged to purchase travel insurance for any reimbursement due to illness in my party.
Insurance
A note about insurance: While you are at my home, your belongings and automobiles are not insured under my commercial vacation rental policy, nor my personal umbrella policy. If you wish your belongings to be insured while you are staying at my home, please talk to your insurance agent about a renter's policy. If you are interested in travel insurance, there are many choices on the web. One that I know of (but have no personal experience with) is http://www.allianztravelinsurance.com/.

For your safety, please, read and obey the following safety precautions.
WARNING - RISK OF CHILD DROWNING:
- Children should be supervised at all times and should not be given access in the spa area.
- Exercise extreme caution to prevent unauthorized access to the spa area by children.
- Keep children away from spa fittings, filter weir and cartridge, floating tablet dispenser, controls, electrical switches, service disconnect panels, equipment and storage areas.
ENTER CAREFULLY! NEVER DIVE INTO SPA. Deck and surfaces are slippery when wet.
USE THE BUDDY SYSTEM NEVER SOAK ALONE USE AT YOUR OWN RISK
SPA USE CAUTION:
- Use of alcohol, drugs or medication before or during spa use is not recommended and may lead to unconsciousness with the possibility of drowning.
- Keep hair and body away from suction fitting covers when spa is in use.
- Never use the spa if the temperature exceeds 104 degrees F (40 deg. C).
- Water temperatures between 100 -104 degrees are considered safe for healthy adults.
- Temperatures of 98-100 are recommended for use by elderly persons and children under 16.
- Prolonged immersion in hot water (over 10 minutes) may induce “hyperthermia” which can cause dizziness, fainting, drowsiness, lethargy and an increase in internal temperature of the body.
- Hyperthermia effects include: unawareness of impending hazard, failure to perceive heat, failure to recognize need to leave spa, physical inability to leave spa, unconsciousness resulting in a danger of drowning, and fever like brain damage in young children under 16.
- Women who are or may be pregnant should not use spa at temperatures over 100 degrees or for long periods of time. Fetal damage may occur.
- Consult your physician before using if you are taking medication, suffer from obesity, heart disease, high or low blood pressure, circulatory problems, or diabetes.
WATER TREATMENT:
- The spa is serviced several times a week –subject to change, weather, holiday, etc.
- The spa water chemistry is adjusted to industry standards with conventional products.
- Bromine and chlorine are the sanitizers. Do not use the spa if sensitive to these products.
- Shower and rinse well before using the spa to remove residual soap, shampoo, lotions, etc.
- Shower after using the spa to cool down, rinse off perspiration and residual sanitizers.
- Young children, not “pool trained”, must wear swim pants if they are allowed to use spa at all.
- Special service calls to clean up spa and or change the water may result in additional charges.
- Please contact Kirstie Wilde 831-595-0670 if the water quality has been compromised by excessive use or accidents.
- Do not use spa if the water is cloudy or has an odor.
I have read, understand and agree with the above, and have shared this information with everyone in my party who will have access to the hot tub.
